What is IRS Representation?
Internal Revenue Service (IRS) is the revenue service of the United States Federal Government. The government agency is a bureau of the Department of the Treasury. It is under the immediate direction of the Commissioner of Internal Revenue and it is directly responsible for collecting taxes as well as the administration of the Internal Revenue Code. The IRS occasionally examines and inspects the tax audits of business organizations and this is where IRS representation comes into play. Thus, IRS representation is a service in which a tax or legal professional stands in on behalf of a taxpayer (an individual or legal entity) during an Internal Revenue Service (IRS) tax audit.
Professional representation can be very vital during a tax audit before the IRS. This is why in the United States, in an income tax audit or examination, the IRS permits a taxpayer to have an authorized professional representative to stand in for him and help him with tax preparation. The representative must be such that is authorized to practice before the IRS and must also possess certain credentials that are required.
There are certain types of representatives who are permitted to represent taxpayers before the IRS during income tax audits. These include attorneys, certified public accountants and enrolled agents. A professional audit representative develops the strategy used to defend the taxpayer’s position. He assists the taxpayer in preparing all documents requested by the taxing authority and also attends all meetings and handles correspondence on behalf of the taxpayer. In addition, he knows likely IRS questions that might be put forward during the proceedings.
Tax Returns and Tax Forms
Apart from IRS representation, tax returns are filed. In the United States, tax returns are reports filed with the Internal Revenue Service (IRS) or with the state or local tax collection agency. Tax returns contain information used to calculate income tax, federal tax, business tax or other taxes. Tax returns are prepared using forms prescribed by the Internal Revenue Service, or other applicable taxation authority. A tax return provides information so that the taxing authority can check on the taxpayer’s calculations, or can determine the amount of tax owed if the taxpayer is not asked to calculate that amount.
The IRS has power to require people to file Federal tax returns under 26 U.S.C. & 6011. People who receive more than the statutory minimum amount of gross income also must file. The standard U.S. individual tax return is Form 1040. There are many variations of this form, such as the 1040EZ and the 1040A, and also many supplemental forms.
There are also tax forms used by taxpayers and tax-exempt organizations to report financial information to the Internal Revenue Service (IRS). Typically, they are used to report income, estimate taxes payable to the federal government of the United States, and disclose other information as required by the Internal Revenue Code (IRC). There are over 800 different forms and schedules. Tax returns must be filed yearly for an individual or business organization that received income during the year, whether by regular income (wages), interest, capital gains, dividends, or other profits.
